STANDARD 12 MONTHS LIMITED MANUFACTURERS WARRANTY FOR APOLLO TRACTORS

The Seller agrees to supply the goods described herein and will provide a Manufacturers 12 MONTHS Limited Warranty on Apollo 4WD Tractors as described herein clause 5a effective from agreement date herein.

All attachments, accessories and options are covered by statutory warranty only.

The buyer agrees to ensure that all persons operating or using the goods are appropriately trained and instructed in the safe and lawful use of the goods. Failure to use the goods in a safe and lawful manner will void all claims for warranty. The buyer further agrees that specifications, style, colour, fit and finish of the goods may change or vary without notice.

Warranty Period

Seller warrants the Apollo tractor Engine and Powertrain only against defects in materials or workmanship for 12 MONTHS from original purchase date. The effective date of purchase is decided solely by the Seller. The Warranty is limited to supply and labour only for a defective part or parts. The goods are not for commercial use or usage deemed by the seller to be of a commercial nature, quality or quantity.

This warranty is valid only for the first original consumer purchaser and is strictly non transferable.

What the warranty protects
This warranty is valid only for the Apollo 4WD Tractors (Apollo tractor Engine and Powertrain) sold and distributed by Xtreme Imports WA Pty Ltd Australia. Please contact the Seller for further warranty information and service. All attachments, accessories and options are covered by statutory warranty only.

Warranty Conditions on Apollo 4WD Tractors

Seller warrants that the Apollo 4WD Tractor is Free from manufacturing defects in materials and workmanship when dispatched from our warehouse. The receipt of purchase shall be provided as proof

This Limited warranty does not cover any losses or damages that occur as a result of, but not limited to:

Accidental Damage, Force Majeure, terrorism,
Buyer transport shipping or improper storage, installation or maintenance.
Misuse and illegal activities.
Removal and or instillation of attachments, accessories and options.
Damage caused by any attachments, accessories and options.
Fair wear and tear, normal usage.
Damage caused by non compliance with operations amendment advice OAA-JM170906
Failure to meet scheduled services intervals.
Torque, twisting, leverage or load damage caused by forklift, backhoe or front loader operations
Non compliance with operational instructions or amendments issued from time to time.
Neglect and abuse either accidental or deliberate.
Rodent, Insect, Environmental and Meteorological conditions
Overheating damage caused by a blocked radiator or failure to clear the radiator of debris.
Non compliance with recommended service schedules
Unauthorised tractor Repairs, adjustment, modification, or installation of options, attachment and parts by anyone other than the Sellers authorised service centre.
Improper Environment. Excessive or inadequate heating or cooling or electrical power failures, surges, or other irregularities.

This warranty is voided for defects resulting from improper maintenance or storage, unauthorised modifications or misuse and operation outside specified environmental conditions.

Persons operating or using the tractor who are children or otherwise inappropriately trained and instructed in the safe and lawful use of the tractor.

Transportation of tractors for scheduled service or warranty to the point of purchase will be conducted at the expense of the buyer. Recovery of tractors from any locations will be at the buyers' expense also.

On site visits made by the Seller's on site service personnel or an authorised service representative will be chargeable at current applicable hourly rates to the customer.

The Buyer must ensure that they are available when the on site service personnel or an authorised service representative arrives to repair, assess or inspect the tractor. Any additional visits made due to the Buyer's unavailability will be chargeable to the customer.

The Seller or an authorised service centre who conducts scheduled warranty services, repairs or required maintenance will pass on all labour costs, charges, fees, oils, coolants, filters, workshop consumable items, and non warranty parts at current premium applicable rates to the Buyer.

Limitation of Implied Warranties
There are no warranties, express or implied, which extend beyond the description contained herein including the implied warranty of merchantability and fitness for a particular purpose. No other warranty is expressed or implied; the Seller and the Importer disclaims any implied warranties of merchantability or fitness for a particular use. This warranty does not limit the Buyer's lawful or statutory rights.

Exclusion of Damages
Seller, Importer, representatives and employees liability is limited to the supply of a defective part only. The Seller, Importer, any representatives and employees, or any other party shall not be liable for:

Damage to other property caused by any defects in the product, Damages based upon inconvenience, loss of use of the product, loss of time, loss of profits, loss of business opportunity, loss of goodwill, interface with business relationships, or other commercial loss, even if advised of their possibility of such damages.

Any other damages, whether incidental, consequential or otherwise. Any claim against the buyer by any other party.

What the warranty does not cover

All attachments, prescribed accessories and optional extras.

Parts deemed as a consumable item, filters, tyres, tubes and belts. Radiator hoses, batteries, bulbs, switches, electrical wiring, relays and fuses. Rubber, fibre, gasket and rubberised components, vinyl, plastic or painted surfaces. Oils, coolant, greases and Lubricants, Hydraulic hoses, seals, washers, o-rings or hydraulic fittings, clutch and brakes.

Any tractor or part, on which the serial number has been defaced, modified or removed.

Damage, deterioration or malfunction resulting from:

Non compliance with operations amendment advice OAA-JM170906
Accident, misuse, neglect, fire, water, lighting, or other acts of nature, unauthorized product modification, or failure to follow instructions supplied with the tractor.
Damage caused by Wear Parts failure such as clutch and brakes
Repair or attempted repair by anyone not authorised in writing by the Seller or Importer. Any damage of the product due to customer shipment.
Removal or installation of attachments, accessories or options.
Damage and impact stress caused by vehicle movement over rough terrain.
Damage caused by the operation and use of any or all attachments, accessories and options.
Causes external to the tractor, such as weather, electrical power fluctuations or failure.
Overheating damage caused by failure to properly maintain and clean radiator of seed and debris.
Use of supplies, non Jinma parts or parts not meeting the Seller or Importers specifications or written approval.
Normal wear and tear, fit and finish of tractor guards, panels, hood and dash
Any other cause which does not relate to a product defect
Mechanical fees, labour and serviceman fees or environmental and workshop consumable charges
Freight and shipping of replacement and defective parts. The seller may require the buyer to return defective and warranty claim parts to the seller at the buyer’s expense.

Force Majeure

The seller shall not be liable in damages and has the right to terminate this Warranty Agreement for any delay or default in performing herein if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any import or other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of the seller whose performance is affected.

Jinma Tractors

Jinma Tractors have a parts only warranty (unless otherwise specified) and based on recreational usage only from the original purchase date. The obligation to the purchaser under this warranty is limited to parts (unless otherwise specified) when the faulty product is returned to your place of purchase. This warranty becomes void if the product has been raced, tampered with, modified, damaged, repaired by unauthorised persons or becomes faulty in any way by improper use.

Xtreme's warranty is limited to defects in workmanship only, and does not apply to loss or damage caused by abnormal or excessive force of any kind from internal or external sources.

Xtreme Imports WA Pty Ltd will decide the appropriate action to undertake with faulty items.

Xtreme Imports WA Pty Ltd, its servants or agents shall not under any circumstance be liable for any injury, loss or damage of any kind, including accessories, arising out of or related to the use, or the inability to use the goods advertised on our website, brochures and advertising, whether goods are defective, malfunction or incorrectly used. This limitation of liability includes but is not limited to incidental, special or consequential damages, damages for loss of business or other profits.

To ensure your product is covered by warranty, the complete faulty product together with your proof of purchase receipt should be returned to your place of purchase.

1 Year Limited Manufacturers Warranty for Jinma 4WD Tractors

1. This 1 Year Warranty is between the Original Purchaser and Xtreme Imports WA Pty Ltd ABN 59 113 590 300 and is strictly non transferable.

2. This warranty is valid only for Jinma 4WD Tractors (Jinma tractor Engine and Powertrain) sold and distributed by Xtreme Machinery (Xtreme Imports WA Pty Ltd). Please contact the Seller for further warranty information and service. All attachments, accessories and options are covered by statutory warranty only.

3. Subject to the Terms and Conditions of this Warranty Xtreme Imports WA Pty Ltd may, at their absolute discretion, consider a request from the Purchaser to replace damaged parts which are covered under the Warranty. Claims must be made by the Purchaser during the Warranty Term.

4. Warranty Term: 1 month against defects in materials and workmanship on all items excluding bulbs, upholstery, plastic shrouds and fuses, and a further 11 Months Warranty on the Engine and Powertrain only from date of purchase.

5. The Warranty is limited to supply only of a defective part or parts, however it is the Purchaser’s responsibility to deliver the Jinma 4WD Tractor to an authorised repairer for servicing or for a Warranty claim. In the event that a mobile repairer is required, travelling costs will be at the Purchasers expense.

6. This Warranty will be void if the Jinma 4WD Tractor is operated outside of Manufacturers recommendations or has been subjected to misuse, accident, owner abuse or modified from Manufacturers specifications.

7. Any benefits conferred by this Warranty on the Purchaser are in addition to any other rights and remedies which are available to the Purchasers law.

8. This Warranty does not cover any consequential loss or damage resulting directly or indirectly from the failure of a Covered item. Further, the Warranty does not cover consequential loss or damage to any person, property or vehicle resulting directly or indirectly from failure of a Covered item.

9. This Warranty does not cover damage caused by corrosion, water submersion, contaminated fuels or additives, overheating or lack of oil.

10. Normal wear and tear is excluded from this Warranty as are normal replaceable service items such as oils, lubricants, coolants, filters, and clutch and brake discs and linings as well as components which are subject to warranty extended by their respective manufacturers such as batteries, injector pumps, injectors and tyres. Additionally, belts, hoses, glass and light bulbs are excluded. Normal deterioration of items such as plastic, rubber and exterior finish due to exposure or harmful substances is also excluded.

11. To enable accurate service scheduling to be maintained it is your responsibility to ensure the odometer and hour meter are operating at all times, failure to do so may void Warranty.

12. To maintain Warranty, the Purchaser must have the Jinma 4WD Tractor serviced as per the owners manual. It is the responsibility of the Purchaser to maintain services and keep invoices for oils, filters and other service items which will be required in the event of a claim. Failure to adhere to these schedules will void the Warranty.

13. In the event of a claim, contact the Claims Department by phoning 08 9471 9788, fax 08 9471 9780 or write to Xtreme Imports WA Pty Ltd 3/4 Cullen Street Bayswater WA 6053 prior to any commencement of any repair. The Claims Department will then direct you to an approved repairer for assessment. Any claim for repairs carried out without prior approval will be denied.

14. All costs and expenses, including fault diagnosis, incurred by the Purchaser in making a claim or complying with the Purchasers obligation under this Warranty shall be their responsibility.

15. These Terms and Conditions form part of the Jinma 4WD Tractor sale contract between the Purchaser and Xtreme Moto Pty Ltd. To the fullest extent permitted by the law and to the extent of any inconsistency between the terms of this Warranty and the terms in the Tractor sale contract.
